Unmasking Germany's Failure in the Oliver K Case-2024
Injustice knows no borders; it cares nothing for color, race, city, or country. Wherever the Rule of Law breaks down and human dignity is trampled, that is the territory of injustice. Silence in the face of oppression, wherever it occurs globally, signifies support for that tyranny and lawlessness.
The tragic case of Oliver K., the young German who disappeared in October 2024, serves as a stark example of this failure. Despite a lack of definitive evidence, German authorities halted the investigation, declaring the site a “burial place.” This unjust decision is a clear violation of fundamental legal and humanitarian principles.
We will not remain silent in the face of this injustice. To do our part in fighting this lawlessness and injustice, we have sent the following official letter to all political and media authorities in Germany. By reading the text below, you too can participate in this urgent call for truth and justice.
Dear Ladies and Gentlemen,
I am addressing you with this letter, not only as a citizen but also in recognition of the responsibility of our Rule of Law towards every individual. The case of the young German, Oliver K., who disappeared in October 2024 in the Ore Mountains (Kippenhainer Stollen, Annaberg-Buchholz), raises serious questions that must not remain unanswered.
Contrary to usual legal procedures, the police, fire department, public prosecutor’s office, and other authorities terminated the investigations and declared the case closed after only a short period. It appears particularly critical that a burial site in the tunnel was authorized without conclusive evidence of Oliver K.’s death being present. This decision contradicts the fundamental provisions of the Missing Persons Act (Verschollenheitsgesetz – VerschG, § 3 ff.), according to which a declaration of death may generally only be issued after ten years – unless there is undeniable evidence of death, which is not the case here.
Furthermore, the Basic Law for the Federal Republic of Germany guarantees in:
Art. 1 Sec. 1 GG: The inviolability of human dignity.
Art. 2 Sec. 2 GG: The right to life and physical integrity.
Art. 20 Sec. 3 GG: The binding of all state organs to law and justice.
A premature and non-transparent termination of the investigations violates these principles. Moreover, it threatens a massive loss of public confidence in the institutions of the Rule of Law.
Additionally, private helpers and friends of the missing person, who continued to gather clues – such as the discovery of yellow rubber boots or further tunnel entrances – were neither adequately heard nor were their findings examined with an open mind. A petition initiated by friends in October 2024, demanding the continuation of the search, also failed to receive a serious response.
All of this gives the impression that the investigation was not conducted with the necessary diligence, transparency, and independence.
Demands
To ensure compliance with the principles of the Rule of Law and the preservation of human dignity, I urgently call upon you on behalf of the public to:
Establish an independent commission of inquiry, consisting of lawyers, criminalists, mining safety experts, and representatives of independent human rights organizations.
Fully disclose all files and governmental decision-making bases, particularly concerning the termination of the search and the authorization of the burial site.
Review the legality of the procedure with regard to the Missing Persons Act and constitutional obligations.
Communicate publicly and transparently about the reasons that led to the exceptionally swift closure of the proceedings.
Conclusion
This case affects not only a single family but the credibility of our entire Rule of Law. When a human life – especially that of a young citizen – is so quickly declared “lost” without exhausting all means of clarification, it sends a dangerous signal.
I urgently appeal to you to support the establishment of an independent truth commission and thus ensure that law, human dignity, and justice are upheld in this case.
